Fishy Business

1. Overview
Fishy Business operates a collective marine livestock purchasing and logistics coordination platform.
Fishy Business facilitates group livestock orders from independent third-party marine suppliers and arranges transport to the Isle of Man once a minimum collective order threshold is met.
Fishy Business does not operate as a traditional pet retailer.
By placing an order through the website, you agree to these Terms & Conditions.
2. Nature of the Service
Fishy Business provides:
- Order aggregation
- Supplier coordination
- Administrative handling
- Logistics organisation
- Transport facilitation
Fishy Business does not:
- Breed livestock
- Maintain holding systems
- Provide livestock warranties
- Guarantee survivability
- Act as a regulated livestock courier
Livestock is supplied by independent third-party marine retailers.
3. Minimum Order Threshold
A minimum collective order value of £500.00 must be reached before delivery will proceed.
If the threshold is not met:
- Orders will not be placed
- No payment will be requested
Fishy Business operates a maximum of one collective delivery per calendar month.
If the threshold is reached early in the month, Fishy Business reserves the right to schedule delivery at a suitable point within that month.
Additional orders may be carried forward to the next delivery cycle.
4. Order Process
Customers submit livestock selections via the website.
Orders contribute toward the collective minimum threshold.
Once the threshold is reached, supplier availability is confirmed.
Customers are notified of confirmed items.
Payment is requested via PayPal.
Upon receipt of payment, the order proceeds to fulfilment and transport.
No order is binding until supplier confirmation and payment have been received.
5. Service Fee
A 17.50% service charge is applied to confirmed orders.
This charge is applied proportionally to ensure fairness across order sizes.
The service charge covers:
- Ferry travel costs
- Fuel
- Collection expenses
- Administrative coordination
- Communication
- Logistics handling
Fishy Business does not intentionally profit from the sale of livestock. The service charge exists to fairly distribute transport and coordination costs.
6. Transport & Collection Model
Transport from the supplier to the Isle of Man is arranged as part of a collective purchasing arrangement.
During initial operations, livestock may be collected and transported by an independent volunteer collector. In early delivery cycles, this may be the operator of Fishy Business.
The collector acts as a transport facilitator and not as a regulated commercial livestock courier.
Fishy Business intends to explore commercial courier arrangements where feasible; however, specialist live marine transport services to the Isle of Man are currently limited.
Fishy Business reserves the right to determine the transport method for each delivery cycle.
7. Risk & Acceptance of Inherent Transport Risks
Customers acknowledge that live marine livestock transport carries inherent risks.
Fishy Business accepts no liability for:
- Supplier delay
- Ferry delay or cancellation
- Weather disruption
- Mortality during transport
- Stress-related illness
- Disease or parasites
- Post-collection mortality
- Compatibility issues
- Changes in behaviour, colouration, or feeding
Customers accept these risks when participating in a collective order.
8. Transfer of Risk
Risk transfers to the customer upon handover of livestock at the Isle of Man collection point.
Fishy Business does not assume ownership of livestock at any stage and acts solely as a coordinator.
9. Collection Responsibilities
Customers are responsible for:
- Prompt collection when notified
- Providing appropriate transport conditions if required
- Proper acclimatisation procedures
- Ensuring aquarium suitability and compatibility
Fishy Business is not responsible for livestock once collected.
10. Availability & Supplier Limitations
Livestock availability is determined solely by the supplier.
Fishy Business is not responsible for:
- Items becoming unavailable
- Supplier substitutions
- Variations in size or condition
If an item is unavailable, customers will not be charged for that item.
11. Refund Policy
Refunds will be provided where:
- The collective threshold is not reached
- An item is confirmed unavailable by the supplier prior to payment
No refunds will be provided for:
- Mortality
- Illness
- Stress-related loss
- Compatibility issues
- Change of mind
- Transport-related delays
12. Limitation of Liability
To the fullest extent permitted by law:
Fishy Business’ total liability shall not exceed the service fee paid in relation to the specific order.
Fishy Business shall not be liable for:
- Indirect or consequential loss
- Loss of livestock
- Tank contamination
- Damage to existing aquarium stock
- Loss of income
13. Force Majeure
Fishy Business shall not be liable for delays or failure caused by events beyond reasonable control, including:
- Weather
- Ferry disruption
- Supplier issues
- Mechanical failure
- Government restrictions
14. Amendments
Fishy Business reserves the right to amend these Terms & Conditions.
The version published at the time of order shall apply.
15. Acceptance
By placing an order, customers confirm that they:
- Understand Fishy Business acts as a facilitator
- Accept the inherent risks of live marine transport
- Agree to the service charge structure
- Accept these Terms & Conditions in full
